Section 6 of the German Occupational Safety Act (ASiG) and DGUV Regulation 2 define how employers must organise safety and occupational health care. Many companies find it challenging to understand the minimum legal requirements and at the same time implement practical solutions. SAFETY & HEALTH Consulting supports you in translating these requirements into clear and workable processes.
Obligations under Section 6 ASiG and DGUV Regulation 2
Employers must appoint a safety engineer or comparable safety professional and an occupational physician. The exact set-up – for example working hours and type of support – depends on the company's activities, number of employees and risk profile. DGUV Regulation 2 specifies these requirements and will be applied in a revised version from the turn of 2025/2026, with a stronger focus on flexible support models and digital advisory services.
Key developments from 2026 onwards
From 2026, parts of the safety and occupational health support may – depending on the accident insurance institution – be provided by telephone or online, provided that an adequate impression of the workplace has been obtained beforehand. Especially for smaller businesses this can mean more flexible service packages and, in many cases, a more efficient use of resources. However, the obligation to carry out a risk assessment and to document measures in a traceable way remains unchanged.
Benefits of external consultancy
External safety professionals bring experience from many different industries and keep an eye on ongoing changes in DGUV regulations and ASiG. Companies benefit from practical recommendations without having to create full-time in-house positions.
